On July 19, 2012, attorney Jacie Zolna filed a whistle blower action on behalf of a former employee of ATI Physical Therapy, one of the largest physical therapy providers in Illinois. The suit alleges, among other things, that ATI Physical Therapy charged private insurance companies for certain physical therapy services that are billed in 15 minute time increments when those services were actually performed for substantially less time than the full 15 minutes and as low as 5 minutes – a practice referred to as the “5 minute rule.” On September 24, 2012, the Court ordered that the case be unsealed and prosecuted.
