Lawsuit Filed Against the City of Chicago for Allegedly Denying Motorists Due Process and Appropriate Notice in Issuing Speed and Red Light Camera Tickets

On March 23, 2015, Jacie C. Zolna filed a class action lawsuit against the City of Chicago seeking recoupment of all fines and penalties paid for alleged speed and red light camera violations, as well as an injunction preventing the City from collecting on or otherwise enforcing outstanding alleged speed and red light camera violations.

On March 23, 2015, Jacie C. Zolna filed a class action lawsuit against the City of Chicago seeking recoupment of all fines and penalties paid for alleged speed and red light camera violations, as well as an injunction preventing the City from collecting on or otherwise enforcing outstanding alleged speed and red light camera violations.  Among other things, the suit alleges that the City ignores the requirement under its own municipal code to issue a second notice of violation and additional 14 day grace period prior to issuing a determination of liability, depriving vehicle owners of the statutorily required due process and pre-liability notice.  The suit also alleges that the City fails to specify all of the required information on the violation notices and prematurely assesses late penalties in violation of its own municipal code.
